Is There a Way to Stop Creditor Harassment?
Absolutely. The Fair Debt Collection Practices Act (FDCPA) and the Florida Consumer Collection Practices Act (FCCPA) allow you to take legal action to stop creditor harassment. If the harassment doesn't stop, you may be awarded damages for their mistreatment.
What if I Actually Owe the Money They Say I Owe?
It doesn't matter how much you owe or how far behind you are in your payments. Debt collectors still have to follow the law. They cannot harass you. They cannot violate the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.
How Do I Know They Are Violating the Law?
The FDCPA and the FCCPA have many provisions that clearly define creditor harassment. In general, the law has been violated if a debt collector does any of the following:
- Threatening arrest or legal action just to harass you
- Makes untrue statements to you or about you
- Uses profane or abusive language
- Fails to cease communication after a written request

What Are My Rights Under the FDCPA and the FCCPA?
The FDCPA is designed to make creditors pay for harassment. If your claim is successful, the debt collector may be required to pay:
