How Do I Know Whether or Not I Have a Wage and Hour Claim?

Despite what your employer may tell you, your rights as an employee have legal protection. You may have a wage and hour claim if:

  • Your employer forces you to perform work duties of any type, including prep work or cleanup, before or after you punch in
  • Your employer does not pay you for the time spent putting on and taking off protective gear required for your job
  • Your employer makes you work through lunch or requires you to punch out for paid breaks
  • Your employer does not pay you for overtime you have worked

Am I Entitled to Overtime Pay?

Unless you are an exempt employee, you are entitled to overtime pay. Overtime pay is time and a half for every hour you put in beyond 40 in any given week.

What Is an Exempt Employee?

The term "exempt employee" is clearly defined in the Fair Labor Standards Act. This is not something that is left up to the judgment of the employer. Typically, an exempt employee is one who performs supervisory duties and not the day-to-day work of hourly employees.

What if I Don't Have My Time Records?

It is your employer's job to keep all time records, not yours. If they have not kept a record or the time you have worked, they are violating the law.
